No.  Colorado does not have any mandatory drug testing statutes or regulations. However, employers in the city of Boulder, CO face stringent drug testing rules, due to a city ordinance.

No, however, employers are strongly encouraged to have a written policy in place (Policy is specifically required to comply with Colorado’s voluntary law).

Yes. Employers may leverage a ‘Rebuttable Presumption of Intoxication’ defense to a Workers’ Compensation Claim, based on a positive drug test result to qualify for a 50% in benefit award. Employers wishing to leverage either of these benefits must voluntarily comply with very detailed program rules.
