For employers, Montana statute does not mandate drug and alcohol testing. Montana law does require all employers using drug and alcohol testing to adopt procedures developed by the DOT (49 Code of Federal Regulations, part 40). Montana law also restricts testing to ensure only employees involved in certain hazardous, security, safety, or fiduciary positions are subject to testing. A written drug free workplace testing is required. Most insurance companies will not pay for accident claims until the individual proves that an accident or incident was not caused by substance abuse or intoxication. Companies without drug free workplace programs should implement such a policy in their business. Immediate drug testing and alcohol testing can easily answer the questions insurance companies and employers are seeking. In Montana, an employee is not eligible for benefits otherwise payable under workers comp laws if the employee's use of alcohol or drugs not prescribed by a physician is the major contributing cause of the accident.

Montana has a law that permits medical marijuana use. Many restrictions apply to the users of medical marijuana, including not being permitted to operate vehicles, heavy machinery or perform other safety-sensitive tasks while under the influence of marijuana. Employers are not required to accommodate marijuana use in the workplace. Public use of marijuana is prohibited.

What Drug and Hair Follicle Drug Testing Reveal in Montana

Each US Drug Test Center in Montana can provide lab drug testing with MRO review. While hair follicle testing reveals what type of drugs are being consumed or have been consumed it is different from urine testing. Hair follicle testing has a longer window of detection.

EtG testing consists of taking a urine sample or hair follicle. Liquid chemicals like alcohol is processed through the body and enters the bloodstream about immediately. The liver is responsible for regulating the blood and glucose levels, which alcohol consumption affects.

A hair follicle sample can detect drug use with one week and up to 90 days after use. Hair follicle testing is highly recommended for employees who are entering highly sensitive areas of employment, where zero tolerance of alcohol and drugs are prohibited. Results are available within 3 to 5 days of testing, and there are no evidence of false positives. Tests are reliable and 100% accurate.
