Yes. North Carolina has specific rules for employers that wish to conduct employee drug testing.
Is a Drug-Free Workplace policy required in North Carolina?
No, however, employers are strongly encouraged to have a written policy in place (Policy is specifically required to comply with the North Carolina’s voluntary law).
What are some compliance requirements in North Carolina?
Employers are required to use HHS/SAMHSA, or CAP approved laboratories. Employers are required to ensure that their service providers comply with all state drug testing laws. At the time of each test, the employer must give the donor a written notice of their rights under the law. On-site testing is permitted for pre-employment drug testing only. Written notice of a positive test result must be given but may be given in any manner such as in person, mail or otherwise. Everyone tested has a right to a retest and must pay all reasonable expenses; reasonable expenses mean in part actual costs of retest and chain of custody procedures.  The individual tested may only be asked to pay up to $15 of this cost.
Are employers in North Carolina able to use drug screening for any other claim defenses or state-specific financial benefits?
Yes. Employers may be able to leverage a ‘Rebuttable Presumption of Intoxication’ defense to a Workers’ Compensation Claim, based on a positive drug test result. A positive drug test may also make an employee ineligible for unemployment compensation if terminated for misconduct. Employers wishing to leverage either of these benefits must voluntarily comply with very detailed program rules.
Does North Carolina authorize marijuana (THC) or cannabidiol (CBD) use?
Yes. North Carolina authorizes the medical use of cannabidiol (CBD) for very limited medical conditions. The law does not address the workplace.

Workplace Drug Testing

Employers in North Carolina may require applicants to take a drug test as a condition of employment. A positive test must be confirmed at an approved laboratory. Applicants have the right to retest a confirmed positive sample at their own expense, at the same lab that confirmed the sample or at another approved lab of their choosing. North Carolina is a drug testing friendly state, where there are no employee drug testing restrictions.

North Carolina does not require an employer to have a written policy before conducting controlled substance testing; however, a written drug free workplace policy is essential to a successful drug prevention program. A written policy will set out the expectations of the particular employer and allow employees and supervisors to become familiar with those expectations.

Employees cheating on a drug test in North Carolina may not remain employed. If the employer has reason to believe that the sample has been adulterated (diluted or contaminated), the employer can refuse that sample for testing. Methods used to determine adulteration include: observation, temperature of sample, pH of sample and specific gravity of sample.
