Minnesota is the 12th largest state in area and the 21st most populous of the U.S. States; nearly 60 percent of its residents live in the Minneapolis–Saint Paul metropolitan area (known as the "Twin Cities"). The Twin Cities area is the center of transportation, business, industry, education and government and home to an internationally known arts community. Minnesota shares a Lake Superior water border with Michigan and a land and water border with Wisconsin to the east. Iowa is to the south, North Dakota and South Dakota are to the west, and the Canadian provinces of Ontario and Manitoba are to the north.
For individuals same day service is available with testing for alcohol and drugs of abuse including: THC (Marijuana), Cocaine, Amphetamine, Methamphetamine, Opiates, PCP, Barbiturates, Benzodiazepines, Methadone, Oxycodone, MDMA, Tricyclic Antidepressants, expanded opiates and more. Hair follicle testing and EtG alcohol testing are also available in Minnesota. For employers, Minnesota is a restrictive State and certain guidelines must be followed. An employer in the state of Minnesota must have a comprehensive drug free workplace policy. All drug and alcohol testing must be conducted by a SAMHSA certified laboratory.
An employer's drug and alcohol testing policy must, at a minimum, set forth the following information: 1. The employees or job applicants subject to testing under the policy 2. The circumstances under which drug or alcohol testing may be requested or required 3. The right of an employee or job applicant to refuse to undergo drug and alcohol testing and the consequences of refusal 4. Any disciplinary or other adverse personnel action that may be taken based on a confirmatory test verifying a positive test result on an initial screening test 5. The right of an employee or job applicant to explain a positive test result on a confirmatory test or request and pay for a confirmatory retest 6. Any other appeal procedures available
Additionally, the employer must provide written notice of its drug and alcohol testing policy to all affected employees upon adoption of the policy, to a previously non-affected employee upon transfer to an affected position under the policy, and to a job applicant upon hire and before any testing of the applicant if the job offer is made contingent on the applicant passing drug and alcohol testing. An employer shall also post notice in an appropriate and conspicuous location on the employer's premises that the employer has adopted a drug and alcohol testing policy. Copies of the policy must be made available for inspection during regular business hours by its employees or job applicants in the employer's personnel office or other suitable locations.
For employers, instant or on site drug testing is prohibited in Minnesota. The testing must be performed by a SAMHSA certified laboratory and this includes alcohol testing. An exception would be DOT alcohol testing which would be with a breathalyzer. Strongly recommended for all drug testing in Minnesota is the use of a Medical Review Officer (MRO).
It is possible in Minnesota to deny a workers comp claim if after an accident the employee tests positive on the drug or alcohol test. If the injury was intentionally self-inflicted or the intoxication of the employee is the proximate cause of the injury, then the employer is not liable for compensation. The burden of proof of these facts is upon the employer.
