No. New Mexico does not have any mandatory drug testing statutes or regulations but it is recommended.
Is a Drug-Free Workplace policy required in New Mexico?
No, however, employers are strongly encouraged to have a written policy in place (Policy is specifically required to comply with the New Mexico’s voluntary law).
Are employers in New Mexico able to use drug screening for any other claim defenses or state-specific financial benefits?
Yes. Employers may be able to leverage an ‘Intoxication’ defense to a Workers’ Compensation Claim, based on a positive drug test result. A positive drug test may also make an employee ineligible for unemployment compensation if terminated for misconduct. Employers wishing to leverage either of these benefits must voluntarily comply with very detailed program rules.
Does New Mexico authorize marijuana (THC) or cannabidiol (CBD) use?

Yes. This state has authorized the use of medical marijuana for limited medical conditions. The law impacts employment drug testing programs. Employers can enforce drug-free workplace policies are not required to accommodate the use of marijuana while at work, however, employers are prohibited from taking any adverse action against an applicant or employee based on the conduct allowed under the state’s medical marijuana law. There are a few exceptions favorable to employers such as those individuals operating in or applying for specific safety-sensitive positions, to remain in compliance with federal laws or federal licensing benefits. Employers may also be required to pay for the cost of medical marijuana as it relates to workers compensation
