Is a Drug-Free Workplace policy required in New Mexico?
No, however, employers are strongly encouraged to have a written policy in place (Policy is specifically required to comply with the New Mexico’s voluntary law).
Are employers in New Mexico able to use drug screening for any other claim defenses or state-specific financial benefits?
Yes. Employers may be able to leverage an ‘Intoxication’ defense to a Workers’ Compensation Claim, based on a positive drug test result. A positive drug test may also make an employee ineligible for unemployment compensation if terminated for misconduct. Employers wishing to leverage either of these benefits must voluntarily comply with very detailed program rules.
Does New Mexico authorize marijuana (THC) or cannabidiol (CBD) use?

Yes. This state has authorized the use of medical marijuana for limited medical conditions. The law impacts employment drug testing programs. Employers can enforce drug-free workplace policies are not required to accommodate the use of marijuana while at work, however, employers are prohibited from taking any adverse action against an applicant or employee based on the conduct allowed under the state’s medical marijuana law. There are a few exceptions favorable to employers such as those individuals operating in or applying for specific safety-sensitive positions, to remain in compliance with federal laws or federal licensing benefits. Employers may also be required to pay for the cost of medical marijuana as it relates to workers compensation

Medical Marijuana Use in the Workplace

The State of New Mexico allows for the medical use of marijuana under the Lynn and Erin Compassionate Use Act. However, the law does not provide immunity from criminal prosecution for using cannabis while on duty or at the workplace.

For purposes of compensation under the Workers' Compensation Act, controlled substance testing performed on a claimant employee may be considered for claims cases only if it complies with federal Department of Transportation procedures for transportation workplace drug and alcohol testing programs. Furthermore, alcohol or drug tests are required to be conducted only by the federal Department of Transportation certified testing laboratories.

Workers' Compensation

Workers' compensation may be reduced by ten percent if intoxication or the use of drugs is only contributory to the injury or death. Otherwise, compensation is altogether prohibited for employees whose injury is solely due to the worker being under the influence of non-prescribed depressant, stimulant, hallucinogenic or narcotic drugs.

The state of New Mexico has no law addressing drug testing in private employment. This means that drug testing is not prohibited, or restricted, unless it violates other legal provisions (such as a law prohibiting discrimination; see below).

Court-Ordered Drug Testing

Many attorneys in New Mexico work with our US Drug Test Centers to order probation and court-ordered drug and or alcohol tests for their clients. These drug tests are often ordered for the following reasons:

All tests performed by US Drug Test Centers are reviewed and reported by a medical review officer (MRO). The MRO reviews the lab results to makes sure the correct test panel was performed and that the correct procedures were followed by the collector. When a drug test is reported positive by the lab, the MRO also contacts the employee to determine if there is a legitimate medical explanation for the positive lab result. Some prescription medications or medical treatments can cause a positive test result. In these cases, the MRO will obtain verification of a valid prescription or recent medical treatment. The test result is then reported to the employer as negative because there is a legitimate, verified medical reason for the positive lab test result. However, if the employee is unable to provide a valid medical explanation for a positive lab test result, the MRO reports the test result as positive to the employer.
