Do employers in Oklahoma need to comply with mandatory state-specific rules when drug & alcohol testing?
Yes. Oklahoma has very specific rules for employers that wish to conduct employee drug testing.
Is a Drug-Free Workplace policy required in Oklahoma?
Yes. Employers must have a written policy. The policy must be provided to employees and to applicants who are accepted as employees in a variety of specific ways (posted internally, physical copies, etc.).
What are some compliance requirements in Oklahoma?

Employers may only test for controlled substances in Schedules I, II, or III. Test facilities must be registered with the state and pay a fee. Onsite (POCT) drug testing is permitted, but with specific requirements. Post-accident drug testing is limited.

Are employers in Oklahoma able to use drug screening for any other claim defenses or state-specific financial benefits?
Yes. Employers may be able to leverage a ‘Rebuttable Presumption of Intoxication’ defense to a Workers’ Compensation Claim, based on a positive drug test result. A positive drug test may also make an employee ineligible for unemployment compensation. Employers wishing to leverage either of these benefits must voluntarily comply with very detailed program rules.
Does Oklahoma authorize marijuana (THC) or cannabidiol (CBD) use?
Yes. This state authorizes the medical use of marijuana and cannabidiol for very limited medical conditions. The law does impact the workplace. Employers are prohibited from discriminating against an individual solely based on their status as a medical marijuana license holder or the results of a positive drug test result for marijuana (with some safety-sensitive position exceptions).
Can I be fired or lose a job offer in Oklahoma if I fail a drug test?
In Oklahoma, if you test positive on a drug test it can be grounds for termination or a rescinded job offer.
