Yes. Rhode Island has very specific rules for employers that wish to conduct employee drug testing.
Is a Drug-Free Workplace policy required in Rhode Island?
Yes. Employers must have a comprehensive policy in place that meets the mandatory state requirements.
What are some compliance requirements in Rhode Island?
Any testing conducted other than post-offer pre-employment and reasonable suspicion, is prohibited. Random testing is limited to safety-sensitive employees only and only permitted for specific industries. Observed collections are prohibited. All confirmation testing must be conducted by a federally certified laboratory. The mandatory law does not address alcohol testing. Employers are prohibited from terminating an employee testing positive for the first time – they must be offered treatment.
Are employers in Rhode Island able to use drug screening for any other claim defenses or state-specific financial benefits?
Yes. Employers may be able to leverage an ‘Intoxication’ defense to a Workers’ Compensation Claim, based on a positive drug test result. A positive drug test or refusal to test may also make an employee ineligible for unemployment compensation when terminated for misconduct. Employers wishing to leverage either of these benefits must voluntarily comply with very detailed program rules.
Does Rhode Island authorize marijuana (THC) or cannabidiol (CBD) use?
Yes. Rhode Island authorizes the medical use of marijuana for very limited medical conditions. Employers are not required to accommodate the use of marijuana at work. Employers are limited in actions based solely on an individual’s status as a certified medical marijuana user.
