The Two Tracks

The Federal Motor Carrier Safety Administration covers CDL drivers operating commercial motor vehicles, the largest regulated population in the state. The Federal Aviation Administration covers pilots, flight crew, mechanics, dispatchers, and other aviation safety sensitive personnel, a large group given Charlotte Douglas operations. The Federal Railroad Administration covers covered rail service employees. The U.S. Coast Guard covers crewmembers on commercial vessels operating out of Wilmington, Morehead City, and the coastal waterways. The Federal Transit Administration covers employees at federally funded transit agencies including CATS and GoTriangle. The Pipeline and Hazardous Materials Safety Administration covers pipeline operations and maintenance staff.
The Federal Panel and Thresholds
DOT testing uses a five panel urine screen analyzed by a laboratory certified by the Department of Health and Human Services: marijuana, cocaine, opiates including hydrocodone, hydromorphone, oxycodone, and oxymorphone, amphetamines including methamphetamine and MDMA, and phencyclidine. Alcohol testing uses evidential breath testing devices, with a violation at 0.04 and required removal from duty at 0.02.A Medical Review Officer reviews every non negative laboratory result and evaluates any legitimate medical explanation before verifying it.
Required Testing Events
Pre employment before performing a safety sensitive function. Random at the annual rates set by each operating administration. Reasonable suspicion based on specific, contemporaneous, articulable observations by a trained supervisor. Post accident under agency specific criteria. Return to duty and follow up testing directed by a Substance Abuse Professional.
Clearinghouse Obligations
North Carolina motor carriers must complete a full pre-employment query in the FMCSA Drug and Alcohol Clearinghouse, run limited queries annually on all current drivers, and report violations, refusals, and return to duty information.
Non DOT Drug Testing Laws in North Carolina
The Controlled Substance Examination Regulation Act & Labs
NC General Statutes sections 95-230 and following govern testing procedures. While North Carolina places no restrictions on when an employer may test, it strictly regulates how testing is performed.Testing must be handled by an approved lab (DHHS-certified or state-approved). Initial positives require confirmation via a second reliable method (like GC/MS)—acting on unconfirmed screens is prohibited.
The Ninety-Day Retest Right & Written Notice
Employers must preserve original samples for approximately 90 days following confirmation of a positive result so examinees can secure an independent retest.Examinees must receive written notification of both the positive result and their retest rights. Disposing of samples prematurely or giving verbal notices violates the statute and carries severe per-examinee penalties.

North Carolina has no medical or recreational cannabis programs or employment protections (though tribal cannabis frameworks on Cherokee land do not override state/federal rules).
