North Dakota Drug Testing Laws for Employers: A DOT and Non DOT Compliance Guide
North Dakota is a permissive state for employer drug testing. There is no comprehensive private employer testing statute, no adult use cannabis program, and no cannabis employment anti discrimination provision. Voters have declined adult use legalization on multiple occasions, most recently in 2024.
What North Dakota does have is one of the most DOT intensive economies in the country relative to its population. The Bakken energy sector generates enormous commercial driving, pipeline, and rail activity, and agriculture adds substantial seasonal trucking on top of it. For many North Dakota employers, federal compliance is the dominant concern and state law is a secondary consideration.

The Two Tracks
Federal DOT testing under 49 CFR Part 40 applies to employees performing safety sensitive functions in regulated transportation industries. North Dakota law does not modify it.
Non DOT testing covers everyone else and operates under North Dakota law and your written policy.
Keep the two programs separate. Even in a permissive state, DOT random pools, panels, thresholds, and consequences are federally dictated and cannot be blended with your general workforce program.

North Dakota's DOT regulated workforce is disproportionately large. Bakken oil and gas operations generate heavy commercial vehicle traffic, crude by rail and pipeline transport are significant, and agricultural hauling adds seasonal volume across the state.
Covered Employee Groups
The Federal Motor Carrier Safety Administration covers CDL drivers operating commercial motor vehicles, by far the largest regulated population in North Dakota. The Pipeline and Hazardous Materials Safety Administration covers pipeline operations, maintenance, and emergency response personnel, a substantial group given the state's gathering and transmission infrastructure. The Federal Railroad Administration covers covered rail service employees, including crude by rail operations. The Federal Aviation Administration covers pilots, flight crew, mechanics, dispatchers, and other aviation safety sensitive employees, including agricultural aviation. The Federal Transit Administration covers employees at federally funded transit agencies.
The Federal Panel and Thresholds
DOT testing uses a five panel urine screen analyzed by a laboratory certified by the Department of Health and Human Services: marijuana, cocaine, opiates including hydrocodone, hydromorphone, oxycodone, and oxymorphone, amphetamines including methamphetamine and MDMA, and phencyclidine. Alcohol testing uses evidential breath testing devices, with a violation at 0.04 and required removal from duty at 0.02.A Medical Review Officer reviews every non negative laboratory result and evaluates any legitimate medical explanation before verifying it.
Required Testing Events & Clearinghouse Obligations
Pre employment, random at annual rates using a scientifically valid method, reasonable suspicion by trained supervisors, post accident, and return-to-duty/follow-up.North Dakota motor carriers must complete full pre-employment queries in the FMCSA Clearinghouse, run annual limited queries, and report violations. Given high Bakken workforce turnover, treat Clearinghouse queries as a strict onboarding gate.
