Pennsylvania Drug Testing Laws for Employers: A DOT and Non DOT Compliance Guide

Pennsylvania has not legalized adult use cannabis, which leads some employers to assume the state is simple. It is not.

Pennsylvania's Medical Marijuana Act contains an express anti discrimination provision, and Pennsylvania courts have held that employees may sue directly under it. The statute also contains a detailed list of safety sensitive duties that certified patients may not perform, which is more specific than what most states provide.

Philadelphia adds a further layer, prohibiting pre employment marijuana testing for most positions.

The Two Tracks

Federal DOT testing under 49 CFR Part 40 applies to employees performing safety sensitive functions in regulated transportation industries. Pennsylvania's medical marijuana protections do not reach federally mandated testing.

Non DOT testing operates under the Medical Marijuana Act, general Pennsylvania employment law, your written policy, and any applicable local ordinance.

DOT Drug and Alcohol Testing in Pennsylvania

Pennsylvania has a large DOT regulated workforce. The Pennsylvania Turnpike, Interstate 76, Interstate 78, Interstate 80, Interstate 81, and Interstate 95 carry enormous freight volume, the state has extensive warehousing and distribution operations, major rail networks, significant pipeline infrastructure serving the Marcellus region, and aviation, transit, and river operations.

  • Covered Employee Groups The Federal Motor Carrier Safety Administration covers CDL drivers operating commercial motor vehicles, the largest regulated population in Pennsylvania. The Federal Railroad Administration covers covered rail service employees. The Pipeline and Hazardous Materials Safety Administration covers pipeline operations and maintenance personnel, a significant group given natural gas gathering and transmission infrastructure. The Federal Aviation Administration covers pilots, flight crew, mechanics, dispatchers, and other aviation safety sensitive personnel. The Federal Transit Administration covers employees at federally funded transit agencies including SEPTA and the Port Authority of Allegheny County. The U.S. Coast Guard covers commercial vessel crewmembers on the Delaware, Ohio, and Monongahela River systems.
  • The Federal Panel and Thresholds DOT testing uses a five panel urine screen analyzed by a laboratory certified by the Department of Health and Human Services: marijuana, cocaine, opiates including hydrocodone, hydromorphone, oxycodone, and oxymorphone, amphetamines including methamphetamine and MDMA, and phencyclidine. Alcohol testing uses evidential breath testing devices, with a violation at 0.04 and required removal from duty at 0.02. A Medical Review Officer reviews every non negative laboratory result and evaluates any legitimate medical explanation before verifying it.
  • Required Testing Events & Clearinghouse Obligations Pre employment, random at annual rates, supervisor-led reasonable suspicion, post accident, and return-to-duty/follow-up events. Pennsylvania motor carriers must complete full pre-employment queries in the FMCSA Clearinghouse, run annual limited queries, and report violations/refusals.
  • Medical Marijuana Certifications Provide Zero DOT Protection Pennsylvania's anti-discrimination provisions do not reach DOT-covered roles. MROs cannot verify marijuana positives as negative based on medical cards. Document DOT designations clearly.

Non DOT Drug Testing Laws in Pennsylvania

  • No General Testing Statute & MMA Anti-Discrimination Provisions Pennsylvania lacks a comprehensive testing statute, mandate, or notice period, giving employers latitude to test under written policies. However, the Medical Marijuana Act (MMA) prohibits discrimination solely based on patient status, and courts permit direct employee lawsuits. Philadelphia adds a local ban on pre-employment marijuana screening for most positions.
  • Employer Rights & Statutory Safety Restrictions Employers are not required to accommodate workplace marijuana use on premises and may discipline workers for being under the influence or failing to meet accepted standards of care. The MMA explicitly restricts patients from performing duties at heights, in confined spaces, handling permit-required chemicals, high-voltage electricity, or tasks deemed life-threatening or public-safety risks without incurring adverse action liability.
