Utah Drug Testing Laws for Employers: A DOT and Non DOT Compliance Guide

Utah has a requirement that exists nowhere else in the country. Under Utah's drug and alcohol testing act, an employer that tests its employees must also subject management to periodic testing. That single provision changes how Utah programs must be structured, and it is the most common gap we find when reviewing policies for employers who have expanded into the state.

Utah also splits its cannabis employment protections in an unusual way, extending them to government employees while leaving private employers largely free to test and act.

The Two Tracks

Federal DOT testing under 49 CFR Part 40 applies to employees performing safety sensitive functions in regulated transportation industries. Utah law does not modify it.

Non DOT testing operates under Utah's drug and alcohol testing act and your written policy.

DOT Drug and Alcohol Testing in Utah

Utah has substantial DOT regulated activity. Interstate 15 and Interstate 80 carry heavy freight, Salt Lake City is a significant aviation and distribution hub, mining and construction generate commercial vehicle traffic, and the state has rail, transit, and pipeline operations.

  • Covered Employee Groups The Federal Motor Carrier Safety Administration covers CDL drivers operating commercial motor vehicles, the largest regulated population in Utah. The Federal Aviation Administration covers pilots, flight crew, mechanics, dispatchers, and other aviation safety sensitive personnel. The Federal Railroad Administration covers covered rail service employees. The Federal Transit Administration covers employees at federally funded transit agencies including the Utah Transit Authority. The Pipeline and Hazardous Materials Safety Administration covers pipeline operations and maintenance staff.
  • The Federal Panel and Thresholds DOT testing uses a five panel urine screen analyzed by a laboratory certified by the Department of Health and Human Services: marijuana, cocaine, opiates including hydrocodone, hydromorphone, oxycodone, and oxymorphone, amphetamines including methamphetamine and MDMA, and phencyclidine. Alcohol testing uses evidential breath testing devices, with a violation at 0.04 and required removal from duty at 0.02. A Medical Review Officer reviews every non negative laboratory result and evaluates any legitimate medical explanation before verifying it.
  • Required Testing Events & Clearinghouse Obligations Pre employment, random at annual rates, supervisor-led reasonable suspicion, post accident, and return-to-duty/follow-up events. Utah motor carriers must complete full pre-employment queries in the FMCSA Clearinghouse, run annual limited queries, and report violations/refusals.
  • Border State Cannabis Confusion Utah borders states with legal cannabis frameworks. Regional drivers consuming cannabis across state lines receive zero protection in DOT tests or under federal law. Reinforce this during orientation.

Non DOT Drug Testing Laws in Utah

  • The Utah Drug and Alcohol Testing Act & Management Testing Requirement Utah Code § 34-38-1+ establishes a voluntary framework offering legal liability protection for employers who comply. However, a unique statutory condition applies: an employer that tests its employees must also subject management to periodic testing. Exempting executives or supervisors violates the act. Programs also require written policies, distributed notices, private collections, certified labs, confirmation testing, and employer-paid testing costs.
  • Cannabis Protections Split & Prescription Medications Private employers in Utah are generally free to test for and discipline marijuana use (including for medical cardholders). Conversely, state and local government employers face statutory restrictions protecting medical cannabis cardholders. Due to heavy pharmaceutical prescribing patterns, MRO review is vital to screen out valid prescriptions and avoid ADA/Utah Antidiscrimination Act liability.
