West Virginia Drug Testing Laws for Employers: A DOT and Non DOT Compliance Guide

West Virginia is the only state in this series where mandatory drug testing sits at the center of an entire industry. State law requires certified miners to undergo pre employment and random drug and alcohol testing, with results reported to state authorities and consequences that reach the miner's certification itself. Separately, contractors performing public improvement work in West Virginia must maintain drug free workplace programs as a condition of the contract.

The Tracks

Federal DOT testing under 49 CFR Part 40 applies to employees performing safety sensitive functions in regulated transportation industries. West Virginia adds two mandatory state frameworks, for mining and for public improvement contracting. The Federal Railroad Administration covers covered rail service employees, a large population given coal rail traffic. The U.S. Coast Guard covers crewmembers on commercial vessels operating the Ohio and Kanawha River systems, including the towboat and barge workforce. The Federal Aviation Administration covers pilots, flight crew, mechanics, dispatchers, and other aviation safety sensitive employees. The Federal Transit Administration covers employees at federally funded transit agencies.
  • The Federal Panel and Thresholds DOT testing uses a five panel urine screen analyzed by a laboratory certified by the Department of Health and Human Services: marijuana, cocaine, opiates including hydrocodone, hydromorphone, oxycodone, and oxymorphone, amphetamines including methamphetamine and MDMA, and phencyclidine. Alcohol testing uses evidential breath testing devices, with a violation at 0.04 and required removal from duty at 0.02. A Medical Review Officer reviews every non negative laboratory result and evaluates any legitimate medical explanation before verifying it.
  • Required Testing Events & Clearinghouse Obligations Pre employment, random at annual rates, supervisor-led reasonable suspicion, post accident, and return-to-duty/follow-up events. West Virginia motor carriers must complete full pre-employment queries in the FMCSA Clearinghouse, run annual limited queries, and report violations/refusals.
  • Industry-Specific Frameworks Federal DOT, state mining certifications, and public improvement contract rules create distinct operational layers. Keep programs strictly segregated.

Specialized State Frameworks: Mining & Public Contracts

  • The Mining Testing Requirement Mandatory drug/alcohol testing for certified miners under the Office of Miners' Health, Safety and Training requires pre-employment and random screenings. Critical Consequence: Confirmed positives or refusals are reported to state authorities, impacting the miner's certification (suspension or revocation) alongside employment actions. Federal MSHA and state rules are separate.
  • Public Improvement Contract Requirements Contractors and subcontractors performing public improvement projects must maintain drug-free workplace programs. This includes written policies, specified random testing rates, compliance affidavits, and strict recordkeeping to maintain bidding eligibility.

Non DOT Drug Testing Laws in West Virginia

  • General Authority & Medical Cannabis Act Protections Outside specialized industries, WV has no comprehensive private testing statute, giving general employers broad discretion to test under written policies. However, the Medical Cannabis Act prohibits discriminating against certified patients solely based on cardholder status. Employers can ban onsite use and discipline for workplace impairment.
  • Statutory Safety Restrictions & Benefits Defense Certified patients are statutorily restricted from working at heights, in confined spaces (including mining), performing life-threatening tasks, handling permit-required chemicals, or high-voltage electricity while under the influence. Workers' comp and unemployment benefits can be denied for intoxication or policy violations, provided testing features proper chain of custody and MRO confirmation.
