Rhode Island restricts drug testing of employees to circumstances in which there is suspicion of drug use or impairment. First-time positives may not result in termination.
Employers in Rhode Island may require applicants to take a drug test after making a condition offer of employment. Employees must be allowed to provide test samples in private, outside the presence of any person. A positive result must be confirmed by a retest in a federally certified laboratory.
An employer may require an employee to take a drug test only if there are reasonable grounds, based on specific, documented observations, to believe the employee may be under the influence of a controlled substance that is impairing job performance. Testing is not allowed in any other situation.
The employee must be allowed to provide the test sample in private, outside the presence of anyone else. A positive test result must be confirmed by a retest in a federally certified laboratory, and the employee has the right to have the sample retested separately at the employer's expense.
An employer may not fire the employee on the basis of a positive drug test result, but must instead refer the employee to a licensed substance abuse professional. After the referral, the employer may require additional testing and may terminate the employee if those test results show that the employee is continuing to use drugs.
Rhode Island has a law that permits medical marijuana use. Employers are prohibited from discriminating against individuals solely based on the fact that he or she may be a qualified medical marijuana user. Many restrictions apply to the users of medical marijuana, including not being permitted to operate vehicles, heavy machinery or performing other safety-sensitive tasks while under the influence of marijuana. Employers are not required to accommodate marijuana use in the workplace. Public use of marijuana is prohibited.
In Rhode Island a workers comp claim can be denied based on a positive drug test - Injuries occasioned by willful intent or intoxication – No compensation shall be allowed for the injury or death of an employee occasioned by his or her willful intention to bring about the injury or death of himself or herself or another, where it is proved that his or her injury or death was occasioned by that conduct, or that the injury or death resulted from his or her intoxication or unlawful use of controlled substances.
