Maryland Drug Testing FAQs

Yes. Maryland has very detailed rules for employers that wish to conduct employee drug testing.
No, however, employers are strongly encouraged to have a written policy in place (Policy is specifically required to comply with the Maryland’s’ voluntary law).
No breath alcohol testing is permitted. Hair testing is specifically permitted but only for pre-employment drug testing, with specific collection procedures. On-site single use screening devices are specifically permitted (devices are required to be FDA approved). Employers or agents conducting (collecting) testing must be registered with the state and pay a fee (every two years). Employers in this state must use a Medical Review Officer (MRO).
Yes. Employers may leverage an ‘Intoxication’ defense to a Workers’ Compensation Claim, based on a positive drug test result; however, there is a presumption that intoxication or drugs did not cause the injury. A positive drug test may also make an employee ineligible for unemployment compensation if terminated for misconduct. Employers wishing to leverage either of these benefits must voluntarily comply with very detailed program rules.
Yes. Maryland has authorized the use of medical marijuana. The law does not directly impact the workplace. The law specifically states that employers do not need to accommodate the use of marijuana while at work.

Depending on if a drug-free workplace program has been implemented, companies may require pre-employment, reasonable suspicion and post-accident testing. Maryland drug testing laws may provide employment-related protections to an employer when action is taken against an employee who violates the company's drug and alcohol policies.

A drug testing program in Maryland should include the following:

Regulations like Maryland Occupational Safety and Health (MOSH) require employers with safety-sensitive employees to undergo mandatory drug testing that must meet DOT and Maryland drug testing regulations. Standard laboratory drug tests provide negative results back in 1 – 2 business days, sometimes specimens have to go on for further testing and results will take 2 – 3 business days longer. Ask about availability for instant drug testing in selected facilities throughout Maryland. For workplace testing, rapid or on-site testing is permitted for pre-employment testing only. For personal or individual drug testing, rapid or on-site testing is permitted.

Maryland drug testing laws allow for the use of hair specimens for pre-employment purposes only. The hair sample must only be one and half inches long from the body and cannot be used for purposes other than for testing for the presence of controlled dangerous substances.
