No, however, employers face limitations with the states’ medical marijuana law.
Is a Drug-Free Workplace policy required in Nevada?
No, however, employers are strongly encouraged to have a written policy in place (Policy is specifically required to comply with the Nevada’s voluntary law).
What are some nuances of the voluntary Drug-Free Workplace Program requirements in Nevada?
All testing must be conducted by approved facilities and methods. Onsite (POCT) testing must be conducted by a facility with a laboratory license.
Are employers in Nevada able to use drug screening for any other claim defenses or state-specific financial benefits?
Yes. Employers may be able to leverage a ‘Rebuttable Presumption of Intoxication’ defense to a Workers’ Compensation Claim, based on a positive drug test result. A positive drug test may also make an employee ineligible for unemployment compensation if terminated due to misconduct. Employers wishing to leverage either of these benefits must voluntarily comply with very detailed program rules.
Does Nevada authorize marijuana (THC) or cannabidiol (CBD) use?

Yes. This state authorizes the medical and adult personal use of marijuana. The laws impact employee drug testing programs. Effective Jan. 1, 2020 employers will be prohibited from taking action on pre-employment drug tests that are positive for marijuana, with limited exceptions. The medical marijuana law provides some limitations on employers related to the discipline of medical marijuana patients. The medical marijuana law appears to place some reasonable accommodation obligations on employers.
