Yes. Employers may be able to leverage a ‘Rebuttable Presumption of Intoxication’ defense to a Workers’ Compensation Claim, based on a positive drug test result. Effective Jan. 1, 2020 employers will be prohibited from taking action on pre-employment drug tests that are positive for marijuana, with limited exceptions. Although many states have passed laws regulating or restricting an employer’s right to require drug testing, Nevada is not one of them. Nevada has no law addressing drug testing in private employment. This means that drug testing is not prohibited or restricted.
