Yes. Employers may be able to leverage a ‘Rebuttable Presumption of Intoxication’ defense to a Workers’ Compensation Claim, based on a positive drug test result. Employers wishing to leverage either of these benefits must voluntarily comply with very detailed program rules.

Yes. This state authorizes the medical and adult personal use of marijuana. The laws impact employee drug testing programs. Nevada Drug Testing Laws

Although many states have passed laws regulating or restricting an employer’s right to require drug testing, Nevada is not one of them. Nevada has no law addressing drug testing in private employment. This means that drug testing is not prohibited or restricted. The only exception is NAC 652 that defines and regulates point-of-care testing (POCT).

Facilities in Nevada providing instant or point of care drug testing are required to be licensed by the Nevada Department of Health and Human Services (DHHS). The Bureau of Health Care Quality and Compliance licenses and certifies medical laboratories, laboratory directors, and laboratory personnel in accordance with Nevada Revised Statutes and Nevada Administrative Code, Chapter 652 Medical Laboratories.

US Drug Test Centers has these licenses in Las Vegas and can perform instant point of collection drug testing with same day drug test results. Post-accident drug and alcohol testing is important for employers, as the outcome of this type of testing can lead to the denial of a workers comp claim. This can save employers a lot of money. If you implement a drug-free workplace policy and always conduct post accident drug and alcohol testing, there will be a return on investment for your drug-free workplace program.

Nevada employers can also save on unemployment claims when implementing comprehensive drug free workplace programs. The policy should outline that a positive drug test is misconduct and the employer terminating the employee for misconduct can avoid an unemployment claim.
