What are some compliance requirements in North Carolina?
Employers are required to use HHS/SAMHSA, or CAP approved laboratories. Employers are required to ensure that their service providers comply with all state drug testing laws. At the time of each test, the employer must give the donor a written notice of their rights under the law. On-site testing is permitted for pre-employment drug testing only. Written notice of a positive test result must be given but may be given in any manner such as in person, mail or otherwise. Everyone tested has a right to a retest and must pay all reasonable expenses; reasonable expenses mean in part actual costs of retest and chain of custody procedures.  The individual tested may only be asked to pay up to $15 of this cost.
