Immediate testing means that the testing itself is done same-day, or immediately, with the results usually reported back the next business day.

Do employers in Vermont need to comply with mandatory state-specific rules when drug & alcohol testing?
Yes. Vermonth has very specific rules for employers that wish to conduct employee drug testing.
Is a Drug-Free Workplace policy required in Vermont?
Yes. Employers must have a written policy in place detailing the procedures, drugs to be screened, and a notice that over-the-counter medications may cause a positive drug test result.
What are some compliance requirements in Vermont?
Employers may only conduct pre-employment testing post-offer. Employers are prohibited from terminating an employee testing positive for the first time – they must be offered treatment. Random testing and companywide testing are prohibited. Blood testing is prohibited, unless specifically requested by an employee. Testing must be conducted by laboratories approved by the state Department of Health. The use of a Medical Review Officer (MRO) is required for all testing.
Are employers in Vermont able to use drug screening for any other claim defenses or state-specific financial benefits?
Yes. Employers may be able to leverage an ‘Intoxication’ defense to a Workers’ Compensation Claim, based on a positive drug test result. A positive drug test or refusal to test may also make an employee ineligible for unemployment compensation if terminated due to misconduct. Employers wishing to leverage either of these benefits must voluntarily comply with very detailed program rules.
Does Vermont authorize marijuana (THC) or cannabidiol (CBD) use?
Yes. Vermont authorizes the adult personal use and the medical use of marijuana and cannabidiol (CBD) for very limited medical conditions. The medical marijuana law does not require an employer to accommodate the use of marijuana at work.

Drug Testing in the Workplace

Vermont's drug testing law is one of the most restrictive in the nation. Vermont allows employers to require applicants and employees to take drug tests, in limited circumstances. Employers are not required to drug test and are not allowed to conduct random testing. A Vermont employer may require an applicant to take a drug test only if the applicant has received a job offer conditioned on a negative test result.

The employer must give applicants a written notice that includes:

  • An explanation of the testing procedure
  • A list of drugs to be tested for
  • A statement that therapeutic levels of prescribed drugs will not be reported

Employers in Vermont may test employees for drugs only if all of the following are true:

  • The employer has reasonable cause to believe that an employee is using drugs or is under the influence
  • The employer has an employee assistance program (EAP) that provides for rehabilitation
  • Employees who test positive and agrees to enter the EAP may not be terminated
  • Random testing is prohibited except for DOT testing

The employer must contract with a Medical Review Officer (MRO) who reviews test results and keeps them confidential. The officer must contact employees or applicants to explain a positive test result. Employees and applicants have the right to an independent retest at their own expense.

An employee who tests positive and agrees to enter the EAP or rehabilitation program may not be terminated. However, the employee may be suspended for up to three months to complete the program. If the employee subsequently tests positive, the employee may be terminated.
