Hawaii Drug Testing FAQs

Yes. Hawaii has very specific rules for employers that wish to conduct employee drug testing.
No, however, employers are strongly encouraged to have a written policy in place (Policy is specifically required to comply with the Hawaii’s voluntary law).

Employers are required to provide anyone that is going to be tested with a written statement of the specific drugs to be tested and a statement that over the counter medications and prescribed medicines could cause a positive drug test. The laboratory cutoff levels for cocaine and amphetamine differ from the standard federal cutoff levels. Medical Review Officers (MRO) must be licensed in Hawaii

Positive tests require notice of results and details of the right to appeal.

Yes, using an FDA cleared device. If an employee or applicants on-site test is “non-negative,” the employer must have the employee or applicant report to an approved laboratory within 4 hours.
Yes. Employers may leverage an ‘Intoxication’ defense to a Workers’ Compensation Claim, based on a positive drug test result. A positive drug test may also make an employee ineligible for unemployment compensation. Employers wishing to leverage either of these benefits must voluntarily comply with very detailed program rules.
Yes. Hawaii permits the medical use of marijuana for patients with limited medical conditions.  The laws do not specifically address the workplace.

Standard laboratory drug tests provide negative results back in 1 – 2 business days, with non-negative results taking anywhere from 3-7 business days. Instant or rapid drug testing is legal in Hawaii. All non-negative drug tests must go to a SAMHSA certified laboratory for confirmation testing and review from our medical review officer.

Hawaii is a drug testing friendly state with few requirements or restrictions. For employee drug testing Hawaii places no restrictions on drug testing circumstances, but has very specific requirements on how drug testing is conducted. The law requires that written notice is given prior to the collection of a sample every time a drug test is conducted.

An employer in Hawaii who wants to drug test employees or applicants must provide advance notice of the testing. The notice must list the substances that will be tested for and must list the prescription and/or nonprescription medications that could cause a positive test result. The employer may not test for any substance that doesn't appear on the list.

Employers must pay all costs of drug testing, including the cost of confirming laboratory tests. Employers are also required to maintain the confidentiality of drug test results.
