Yes. This state has authorized the use of medical marijuana for limited medical conditions. The law impacts employment drug testing programs. Employers can enforce drug-free workplace policies are not required to accommodate the use of marijuana while at work, however, employers are prohibited from taking any adverse action against an applicant or employee based on the conduct allowed under the state’s medical marijuana law. There are a few exceptions favorable to employers such as those individuals operating in or applying for specific safety-sensitive positions, to remain in compliance with federal laws or federal licensing benefits.
