Yes. Idaho provides employers with the ability to voluntarily participate in a Drug-Free Workplace Program to qualify for workers’ compensation insurance premium reductions. Employers wishing to leverage these benefits must voluntarily comply with very detailed program rules.
Are employers in Idaho able to use drug screening for any other claim defenses or state-specific financial benefits?
Yes. Employers may leverage an ‘Intoxication’ defense to a Workers’ Compensation Claim, based on a positive drug test result. A positive drug test may also make an employee ineligible for unemployment compensation (must follow rules of voluntary law). Employers wishing to leverage either of these benefits must voluntarily comply with very detailed program rules.
What are some nuances of the voluntary Drug-Free Workplace Program requirements in Idaho?
Employers must conduct drug testing post-offer to comply with the Americans with Disabilities Act (ADA). Donors wishing to challenge their drug test result must request the retest within seven working days. If the retest results are overturned to a negative, the employer must pay for the cost of the retest. Alcohol positives are considered anything at or above .02.
Does Idaho authorize marijuana (THC) or cannabidiol (CBD) use?
No. Idaho does not authorize the use of marijuana or cannabidiol.
