The most populated state in the New England region, a rich historical state full, home to our first settlement at Plymouth Rock. Home to over 6 million citizens, Fenway Parks' Green Monster and Martha's Vineyard, Massachusetts is full of life, sports fanatics and American history.

Sadly, Massachusetts is also home to an increasing number of opioid-related deaths that have been on the rise since 2014. The highest concentrations of these cases are in Essex, Middlesex and Suffolk Counties. As a result of this, drug screening processes have expanded across all industries and especially in industries with safety-sensitive employees.

Individuals who need a drug test in Massachusetts need to look no further. US Drug Test Centers offers drug and alcohol testing in all areas of the state. Our drug testing services are available for probation, divorce cases, child custody cases, owner operator truck drivers and court-ordered drug testing. We work with many law firms and DOT compliant companies.

Massachusetts Drug Testing FAQs

Do employers in Massachusetts need to comply with mandatory state-specific rules when drug & alcohol testing?
Yes. Massachusetts has rules based on court decisions versus legislative actions.
Is a Drug-Free Workplace policy required in Massachusetts?
No, however, employers are strongly encouraged to have a written policy in place (Policy is specifically required to comply with the states’ voluntary law).
What are some compliance requirements in Massachusetts?
Random testing is limited to safety-sensitive employees only.  Employers should only conduct post-accident testing when they have reason to believe the individual(s) caused or contributed to the incident.
Are employers in Massachusetts able to use drug screening for any other claim defenses or state-specific financial benefits?
Yes. Employers may be able to leverage an ‘Intoxication’ defense to a Workers’ Compensation Claim, based on a positive drug test result. However, no specific rules exist. A positive drug test may also make an employee ineligible for unemployment compensation if terminated for misconduct. Employers wishing to leverage either of these benefits must voluntarily comply with very detailed program rules.
Does Massachusetts authorize marijuana (THC) or cannabidiol (CBD) use?

Massachusetts has authorized the personal adult use and the medical use of marijuana. While employers are still permitted to enforce workplace policies and are not required to accommodate marijuana use while at work; the state’s medical marijuana law does limit employer actions. Employers are prohibited from discriminating against a qualified person due to their status as a medical marijuana patient.

Drug and Alcohol Testing for Employers and Individuals

US Drug Test Centers offers testing for employers and individuals throughout the state of Massachusetts. You can purchase testing online, or give us a call and speak with one of our knowledgeable staff for help finding the right test. We provide hair follicle testing, EtG tests, instant POCT testing and urine testing, including 5-panel drug tests and 10-panel drug tests. Many of our locations will give you results on the same day for negative results.

Random drug testing should be limited to safety-sensitive workers or other circumstances where an employer can show a legitimate business necessity. The Massachusetts Supreme Court has issued a ruling on random drug testing in private employment. In Webster v. Motorola, the Court found that the validity of an employer's policy of random drug testing had to be weighed on a case-by-case basis.

Typically employers order a five-panel or ten-panel urine drug test. Hair testing is also available, typically a five-panel drug test. Many times employers will also order drug testing to include OxyContin and other drugs. Employers in Massachusetts can set up drug testing in one day with a quick phone call to US Drug Test Centers at 1-866-566-0261.

All of our drug testing in Massachusetts is conducted by SAMHSA certified laboratories and drug test results are reviewed and verified by the medical review officer (MRO). DOT regulated companies can call US Drug Test Centers for a complete DOT drug and alcohol testing program. Random consortium programs are available with same day set up.

Marijuana Use in the Workplace

While Massachusetts has legalized medical marijuana, there is nothing in the law that requires employers to accommodate marijuana use at the workplace. Regarding medical marijuana laws, the general consensus in the courts and the legal commentaries is that these laws do not require employers to modify their employment practices, drug-free workplace policies, drug testing policies, or accommodation policies.

US Drug Test Centers can help you create a drug-free workplace policy and program, or update your existing policy to address the use of medical marijuana. Our knowledgeable staff can answer any and all of your questions when it comes to current medical marijuana laws in Massachusetts and how to effectively implement policies pertaining to these laws. Give us a call today at 1-866-566-0261.
