Same day service is always available and at many locations, instant testing is offered, with negative drug test results available on the same day. US Drug Test Centers can provide drug testing with Chain of Custody Paperwork or electronic chain of custody, which is commonly called eChain. With the eChain system, you can be e-mailed your drug testing order and you can go to our facilities on the same day. Are employers in Massachusetts able to use drug screening for any other claim defenses or state-specific financial benefits?
Yes. Employers may be able to leverage an ‘Intoxication’ defense to a Workers’ Compensation Claim, based on a positive drug test result. However, no specific rules exist. A positive drug test may also make an employee ineligible for unemployment compensation if terminated for misconduct. Employers wishing to leverage either of these benefits must voluntarily comply with very detailed program rules.
Does Massachusetts authorize marijuana (THC) or cannabidiol (CBD) use?

Massachusetts has authorized the personal adult use and the medical use of marijuana. While employers are still permitted to enforce workplace policies and are not required to accommodate marijuana use while at work; the state’s medical marijuana law does limit employer actions. Employers are prohibited from discriminating against a qualified person due to their status as a medical marijuana patient.

Drug and Alcohol Testing for Employers and Individuals
