In Virginia, the State laws on drug testing are not at all restrictive. Employers are welcome to implement drug free workplace programs. A voluntary law exists with a 5% workers' compensation premium available for companies that institute and maintain a drug-free workplace program satisfying criteria that each insurer shall establish. Companies in the mining industry are required to comply with the provisions of the mining drug-free workplace law. VIRGINIA Workers' Compensation denies benefits to an employee whose injury is caused by intoxication or use of nonprescribed controlled substances.
Courts in Virginia have stated that a "confirmed positive test" must satisfy three requirements:
- The test was conducted pursuant to a "known workplace drug policy,"
- The testing and sampling were performed "in accordance with scientifically recognized standards,"
- The testing lab was "accredited" or the test was a DOT qualified drug screen.
