Do employers in Georgia need to comply with mandatory state-specific rules when drug & alcohol testing?
No. Georgia does not have any mandatory drug testing statutes or regulations but it is recommended.
Is a Drug-Free Workplace policy required in Georgia?
No, however, employers are strongly encouraged to have a written policy in place (Policy is specifically required to comply with the Georgia’s voluntary law).
Are employers in Georgia able to leverage their drug screening program to reduce their Worker’s Compensation Insurance costs?
Yes. Georgia provides employers with the ability to voluntarily participate in a Drug-Free Workplace Program to qualify for workers’ compensation insurance premium reductions. Employers wishing to leverage these benefits must voluntarily comply with very detailed program rules.
Are employers in Georgia able to use drug screening for any other claim defenses or state-specific financial benefits?
Yes. Employers may leverage a ‘Rebuttable Presumption of Intoxication’ defense to a Workers’ Compensation Claim, based on a positive drug test result. A positive drug test may also make an employee ineligible for unemployment compensation (program must also follow rules of the state’s Drug-Free Workplace Program). Employers wishing to leverage either of these benefits must voluntarily comply with very detailed program rules.
Does Georgia authorize marijuana (THC) or cannabidiol (CBD) use?
Yes. Georgia permits medical cannabidiol (CBD) use for patients that meet specific medical conditions. The law does not specifically impact employment drug testing programs.
