No, however, employers are strongly encouraged to have a written policy in place (Policy is specifically required to comply with Arkansas’ voluntary law).

Yes. Arkansas provides employers with the ability to voluntarily participate in a Drug-Free Workplace Program to qualify for workers’ compensation insurance premium reductions. Employers wishing to leverage these benefits must voluntarily comply with very detailed program rules.
What are some nuances of the voluntary Drug-Free Workplace Program requirements in Arkansas?
Requires the use of a SAMHSA certified laboratory. Drug testing panels, methods and reasons to test are limited. The use of a Medical Review Officer (MRO) is required.
Are employers in Arkansas able to use drug screening for any other claim defenses or state-specific financial benefits?
Yes. Employers may leverage an ‘Intoxication’ defense to a Workers’ Compensation Claim, based on a positive drug test result. Does Arkansas authorize marijuana (THC) or cannabidiol (CBD) use?
Yes. Arkansas permits the medical use of marijuana for patients that meet specific medical conditions. The law does not specifically impact employment drug testing programs.

Types of Drugs We Test For

The US Drug Test Centers team is qualified to perform a wide range of individual and business drug tests, including:

EtG Tests
We evaluate how much alcohol has been within the subject's system for the past 80 hours.

Breath Tests
We assess the amount of alcohol in a subject's system at the time the test is conducted.

5-Panel Hair Tests
We use hair follicles to test for cocaine, amphetamines, opiates, marijuana, and PCP. We also offer 9-panel tests, which look for all of the above as well as barbiturates, benzodiazepines, methadone, and propoxyphene.

DOT Tests
We test for cocaine, opiates, amphetamines, marijuana, and PCP according to the Department of Transportation's regulations. We also provide DOT consortium random testing, hair follicle drug testing, and EtG hair testing for alcohol. All are DOT compliant.

Instant Rapid Tests
The results for these tests are available at most locations on the same day that the tests are administered. We offer both 6-panel tests (for cocaine, amphetamines, methamphetamines, opiates, PCP, and marijuana) and 10-panel tests (for all of the above as well as barbiturates, methadone, propoxyphene, and benzodiazepines).
