No. New York does not have any mandatory drug testing statutes or regulations; however, employers in New York City are prohibited from screening for marijuana use in pre-employment drug tests (effective 5/10/2020).
Is a Drug-Free Workplace policy required in New York?
No, however, employers are strongly encouraged to have a written policy in place (Policy is specifically required to comply with the New York’s voluntary law).
Are employers in New York able to leverage their drug screening program to reduce their Worker’s Compensation Insurance costs?
Yes. New York provides employers with the ability to voluntarily participate in a Drug-Free Workplace Program to qualify for workers’ compensation insurance premium reductions. Employers wishing to leverage these benefits must voluntarily comply with very detailed program rules.
Are employers in New York able to use drug screening for any other claim defenses or state-specific financial benefits?
Yes. Employers may be able to leverage an ‘Intoxication’ defense to a Workers’ Compensation Claim, based on a positive drug test result. A positive drug test may also make an employee ineligible for unemployment compensation if terminated for misconduct. Employers wishing to leverage either of these benefits must voluntarily comply with very detailed program rules.
What are some nuances of the voluntary Drug-Free Workplace Program requirements in New York?
Employers must use approved laboratories. The use of onsite (POCT) drug testing is restricted under the states’ clinical laboratory law. The use of a Medical Review Officer (MRO) is required.
Does New York authorize marijuana (THC) or cannabidiol (CBD) use?
Yes. While this state does not officially permit the personal adult use of marijuana, employers in New York City are prohibited from requiring a job applicant to submit to a drug test for marijuana as a condition of employment, effective May 10, 2020, with limited exceptions. This state has also authorized the use of medical marijuana for limited medical conditions. The law limits employer actions. The state has concluded that medical marijuana patients are deemed to have a disability, afforded protections under New York’s Human Rights Law.
Can I be fired or lose a job offer in New York if I fail a drug test?
In New York, if you test positive on a drug test it can be grounds for termination or a rescinded job offer.
