No. Pennsylvania does not have any mandatory drug testing statutes or regulations but it is recommended.
Yes. Employers may be able to leverage an ‘Intoxication’ defense to a Workers’ Compensation Claim, based on a positive drug test result. A positive drug test or refusal to test may also make an employee ineligible for unemployment compensation. Employers wishing to leverage either of these benefits must voluntarily comply with very detailed program rules.
Yes. Pennsylvania authorizes the medical use of marijuana for very limited medical conditions. Employers are limited in actions based solely on an individual’s status as a certified medical marijuana user. Medical marijuana employee/patient prohibitions exist, especially in safety-sensitive positions. Employers are strongly encouraged to indicate in their policy that marijuana use is prohibited.

Cheating on the drug test in Pennsylvania can lead to problems with the law. It is a third degree misdemeanor to offer for sale, to sell, cause to be sold or to give away drug-free urine for the purpose of cheating a drug test. It also is a third degree misdemeanor to use drug-free urine for the same purposes.

Employer Drug Testing in Pennsylvania
