No. Florida does not have any mandatory drug testing statutes or regulations but it is recommended.
Is a Drug-Free Workplace policy required in Florida?
No, however, employers are strongly encouraged to have a written policy in place (Policy is specifically required to comply with the Florida’s voluntary law).
Are employers in Florida able to leverage their drug screening program to reduce their Worker’s Compensation Insurance costs?
Yes. Florida provides employers with the ability to voluntarily participate in a Drug-Free Workplace Program to qualify for workers’ compensation insurance premium reductions. Employers wishing to leverage these benefits must voluntarily comply with very detailed program rules.
Are employers in Florida able to use drug screening for any other claim defenses or state-specific financial benefits?
Yes. Employers may leverage an ‘Intoxication’ defense to a Workers’ Compensation Claim, based on a positive drug test result. A positive drug test may also make an employee ineligible for unemployment compensation. Employers wishing to leverage either of these benefits must voluntarily comply with very detailed program rules.
What are some nuances of the voluntary Drug-Free Workplace Program requirements in Florida?
Employers must have a policy that follows the rules defined by the Florida Department of Health. Employees and applicants must be provided notice with the list of drugs to be tested and their related street names. Construction contractors in public works projects must comply with the states Drug-Free Workplace Program.
Does Florida authorize marijuana (THC) or cannabidiol (CBD) use?
Yes. Florida permits the medical use of marijuana for patients with limited medical conditions.  The laws do not specifically impact the workplace.

Florida Drug-Free Workplace Programs

In 1990, legislation was enacted that created the Florida Drug-Free Workplace Program. The intent was to promote drug-free workplaces in Florida, in order for employers be afforded the opportunity to maximize their levels of productivity, enhance their competitive positions in the marketplace, improve safety in the workplace and reach their desired levels of success without experiencing the costs, delays and tragedies associated with work-related accidents from drug abuse by employees. The Florida drug and alcohol test became a pivotal part of this.

Companies in Florida can implement a drug-free workplace program and save 5% on workers compensation insurance. This is a voluntary program and assistance is available from US Drug Test Centers. Many benefits are available to companies and employers who implement the drug-free workplace program in Florida, including:

  • Employees will become more aware of safety in the workplace and will benefit from a safer work environment, which would include fewer accidents on the job
  • After a positive drug test, an employee who loses a job may not qualify for unemployment compensation benefits
